CI Crew Tracker Terms of Service

These Terms of Service ("Terms") govern access to and use of CI Crew Tracker, an internal crew scheduling and time-tracking application operated by CI Management ("CI Management," "we," "us," or "our").

By accessing or using CI Crew Tracker, you acknowledge that you have read and agree to these Terms and the CI Crew Tracker Privacy Policy. If you do not understand or agree to these Terms, contact a CI Management administrator before using the application.

1. Eligibility and Authorized Use

CI Crew Tracker is available only to individuals who:

  • Have been invited or authorized by CI Management
  • Are using the application for legitimate CI Management work
  • Are legally permitted to perform the assigned work
  • Can enter into or acknowledge these Terms as permitted by applicable law

CI Crew Tracker is not available for public registration or personal use. CI Management may approve, deny, suspend, deactivate, or revoke access when reasonably necessary.

2. User Accounts

Users must provide accurate account information and keep it reasonably current.

You are responsible for:

  • Maintaining the confidentiality of your password
  • Using your own assigned account
  • Preventing unauthorized access from your device
  • Signing out of shared or unsecured devices
  • Promptly reporting suspected account misuse or unauthorized access

You may not share credentials, use another person's account, allow another person to clock in or out for you, or impersonate another worker or administrator.

3. User Roles

Workers

Workers may use the application to:

  • View assigned events
  • View relevant event details and responsibilities
  • Clock in and out
  • Add permitted notes
  • View their own recorded hours
  • Update their own phone number

Administrators

Authorized administrators may use the application to:

  • Create and manage events and event locations
  • Invite and manage workers
  • Assign workers to events
  • View crew profiles, assignments, and time entries
  • Review and adjust time entries
  • Record reasons for administrative adjustments
  • Manage authorized roles and permissions
  • Export staffing lists and clock-in reports
  • Review audit and operational records

Administrator access is limited to authorized business purposes. Administrators must not access, export, alter, or disclose crew information for personal, discriminatory, retaliatory, or otherwise unauthorized purposes.

4. Scheduling and Assignments

CI Crew Tracker may display event schedules, call times, roles, responsibilities, notes, and other work information.

Users are responsible for reviewing their assignments and promptly reporting errors, conflicts, or unclear instructions. An assignment displayed in the application may be updated by an authorized administrator.

Unless CI Management expressly states otherwise, information in CI Crew Tracker does not independently guarantee a minimum number of hours, future assignments, continued engagement, or any specific employment or contractor status.

5. Clock-In, Clock-Out, and Accurate Records

Workers must make good-faith efforts to:

  • Clock in when they begin compensable or authorized work
  • Clock out when they stop such work
  • Use only their own account
  • Submit accurate notes
  • Promptly report missed, duplicate, blocked, or inaccurate entries

Users must not falsify timestamps, coordinates, notes, assignments, or other application records. Users must not manipulate device settings, location services, QR codes, requests, or application behavior to create a false time or location record.

Application records may be reviewed and corrected by authorized administrators. Administrative changes may be recorded in an audit log.

The application may experience device, location, connectivity, or software errors. A failed or inaccurate clock action does not eliminate a worker's obligation or right to report hours actually worked. Workers should notify an administrator as soon as possible so the record can be reviewed and corrected.

Nothing in these Terms waives any right to payment for compensable time or any other non-waivable right under applicable law.

6. Location Verification

When a worker initiates a clock-in or clock-out, CI Crew Tracker may request the device's current location. The application uses the coordinates to calculate the device's approximate distance from the assigned event location and determine whether it is within a configured geofence.

By choosing to use the clock-in or clock-out feature after receiving the location notice, you authorize CI Management to collect and use the device location for attendance verification, timekeeping review, operational administration, payroll-related review, security, and dispute resolution as described in the Privacy Policy.

CI Crew Tracker does not continuously track location. Location is requested when the user initiates a clock-in or clock-out action.

If location permission is denied, unavailable, or inaccurate, the standard clock feature may not work. Contact an administrator for an approved alternative or correction process. Do not attempt to bypass the geofence or falsify location information.

7. Optional Camera and QR-Code Scanner

Workers may choose to use the device camera to scan an event-specific QR code. Camera use is optional.

QR-code video frames are processed locally in the browser. CI Crew Tracker does not upload or store the scanner's camera images or video. The application does not use the microphone.

Scanning a QR code opens an event screen. It does not automatically clock the user in or out.

8. Notes and User-Submitted Content

Users may enter notes concerning assignments, responsibilities, clock actions, or timekeeping issues. Notes must be accurate, relevant, professional, and appropriate for a workplace system.

Do not submit:

  • Unlawful, threatening, harassing, discriminatory, or defamatory content
  • Unnecessary sensitive personal information
  • Medical details unless specifically required through an approved process
  • Passwords, financial information, government identification numbers, or other credentials
  • Malicious code, scripts, or content intended to disrupt the application
  • Confidential third-party information you are not authorized to disclose

CI Management may review, preserve, correct, or remove content when reasonably necessary for operational, legal, security, or policy purposes.

9. Acceptable Use

You may not:

  • Access records or functions outside your authorized role
  • Attempt to bypass authentication, Row Level Security, geofences, or other controls
  • Probe, scan, test, or exploit the application without written authorization
  • Introduce malware or interfere with application availability
  • Scrape, copy, or export data for an unauthorized purpose
  • Reverse engineer the application except where applicable law expressly permits it
  • Use automated tools to overload the application
  • Alter or conceal audit records
  • Use information obtained through the application to harass, discriminate against, retaliate against, or harm another person
  • Violate law, workplace policy, contractual obligations, or the rights of others

CI Management may investigate suspected misuse and may preserve or disclose relevant records as permitted by law.

10. Reports and Exports

Authorized administrators may generate staffing lists and time reports as PDF files. Exported files may contain confidential worker, scheduling, location, or timekeeping information.

Administrators must:

  • Export information only for an authorized business purpose
  • Store exported files securely
  • Limit access to individuals with a legitimate need
  • Avoid sending files through insecure or unauthorized channels
  • Delete files when they are no longer needed, subject to recordkeeping requirements

11. Privacy

The CI Crew Tracker Privacy Policy explains how information is collected, used, stored, and disclosed. By using the application, you acknowledge the practices described in that policy.

The application's request for device permissions does not authorize unrelated access to a device. Location is used as described for clock actions, camera access is optional for QR scanning, and microphone access is disabled.

12. Third-Party Services

CI Crew Tracker relies on third-party infrastructure and software, including Lovable Cloud, Supabase, Google Fonts, jsPDF, and jsQR. Those services and components may be governed by separate terms and privacy practices.

CI Management does not control every interruption, change, or failure involving a third-party service. We may replace or modify service providers or application components when reasonably necessary.

13. Application Availability and Changes

CI Management may update, modify, suspend, or discontinue features of CI Crew Tracker. We may perform maintenance or take emergency action to protect the application or its data.

We aim to keep the application available and accurate, but uninterrupted or error-free operation is not guaranteed. Users must promptly report scheduling, timekeeping, location, account, or security problems.

14. Suspension and Termination

CI Management may suspend or deactivate an account when:

  • The user's work relationship or authorization ends
  • The account presents a security risk
  • The user violates these Terms or applicable policy
  • The account is inactive
  • Suspension is reasonably necessary for an investigation, legal obligation, or operational purpose

Account deactivation does not necessarily delete timekeeping, audit, payroll, security, or business records.

15. Ownership

CI Crew Tracker, including its software, design, branding, documentation, and related materials, is owned by or licensed to CI Management and is protected by applicable law.

Users receive a limited, revocable, non-transferable right to use the application only for authorized CI Management work. No ownership right is transferred to a user.

Users retain any rights they may have in content they submit. Users authorize CI Management to use that content as reasonably necessary to operate the application, manage work, maintain records, investigate issues, and comply with legal obligations.

16. Employment and Contractor Matters

These Terms govern use of the application. They do not, by themselves:

  • Create an employment, partnership, joint venture, or agency relationship
  • Change a user's existing employment or contractor classification
  • Replace an employment agreement, contractor agreement, handbook, workplace policy, collective bargaining agreement, or applicable law
  • Waive rights or obligations that cannot legally be waived

If these Terms conflict with a controlling written agreement or applicable law concerning wages, hours, or worker rights, the controlling agreement or law will apply to that issue.

17. Disclaimers

To the fullest extent permitted by law, CI Crew Tracker is provided for internal operational use on an "as available" basis. CI Management does not guarantee that every schedule, location reading, calculation, notification, or time entry will always be complete, accurate, current, or uninterrupted.

Users are responsible for reporting errors promptly. CI Management remains responsible for handling timekeeping and worker records as required by applicable law.

Nothing in these Terms excludes a warranty, duty, or liability that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, CI Management will not be liable under these Terms for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use the application.

This limitation does not apply to unpaid compensation, willful misconduct, gross negligence, violations of non-waivable worker rights, or any liability that cannot legally be limited.

19. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory law applies.

Any dispute concerning these Terms that is not controlled by another binding agreement must be brought in a court with proper jurisdiction in the Florida county where CI Management maintains its principal office, unless applicable law requires another location.

20. Changes to These Terms

CI Management may revise these Terms when the application, business practices, or applicable requirements change. The revised Terms will show a new "Last updated" date.

When changes are material, CI Management may provide notice through the application, by email, or through another appropriate workplace communication. Continued use after the revised Terms take effect constitutes acknowledgment of the revised Terms to the extent permitted by law.
